More Biometric Litigation: Former Employee Files Privacy Suit Against Dollar Tree

Dollar Tree StoreA former Dollar Tree employee in Illinois has filed a proposed class action against the company and its subsidiary, Family Dollar Inc., for violating the Illinois Biometric Information Privacy Act (BIPA) by requiring employees to scan their fingerprints every day to clock in and out of work.

BIPA prohibits private entities from collecting, storing, buying, or selling an individual’s biometric information without first informing the individual in writing about what information is being collected and the purpose, and receiving a written release from the individual.

In Mantrise Herron v. Family Dollar Inc. et al., former Dollar Tree employee Mantrise Herron alleges that she did not provide consent to be fingerprinted by her employer, to have her fingerprints stored, or for her biometric information to be used for any reason. The complaint stated that Dollar Tree and Family Dollar failed to follow BIPA protocols by not informing employees about the purpose of collecting their biometric data and did not let workers know what would happen to their biometric data after they left the company.

Herron seeks to represent a class of all individuals at Illinois Dollar Tree or Family Dollar stores whose biometrics were scanned during their employment.

The lawsuit seeks damages of $1,000 for each negligent incident of employee biometric data collection, $5,000 for each willful incident, and $1,000 to each class member for the retailers’ violation of BIPA.
