A Mercedes-Benz USA LLP veteran employee has dismissed his proposed class action lawsuit against his employer without prejudice. James Click, who has worked for Mercedes-Benz since 1996, filed suit against the company for failing to pay workers overtime pay after its Kronos payroll system fell victim to a ransomware attack in December 2021. Click gave no indication why he was dismissing his claims in his notice of dismissal.
In his complaint, which he filed in April 2022, Click claimed that Mercedes-Benz was only one of the various companies affected by the Kronos hack. Instead of implementing any replacement system to record employee time accurately and compensate them accordingly, Mercedes-Benz wrongly used prior pay periods or reduced payroll estimates to calculate wages after their payroll and timekeeping system crashed.
Click alleged he and other similarly situated workers did not receive the proper overtime premiums or pay for the correct number of overtime hours. Click sought to represent a class of workers who were non-exempt under the Fair Labor Standards Act (FLSA) and who worked for Mercedes-Benz after the system hack occurred.
The case is Click v. Mercedes-Benz USA LLC, case number 1:22-cv-01422, U.S. District Court for the Northern District of Georgia.
